Pretrial Intervention Level 2 General Program

Program Description

Pretrial Intervention (PTI) Level 2 is administered by the Department of Corrections. The program offers eligible accused persons an opportunity to avoid prosecution by completing supervised conditions tailored to promote accountability and reduce recidivism. This program is available for individuals charged with certain qualifying misdemeanor offenses or third-degree felonies. Forcible felonies and non-F3 charges are not eligible.

Participation PTI Level 2 is based on a formal agreement. The accused person, their attorney, the assigned prosecutor, and the probation officer must all sign a contract outlining the conditions that must be successfully completed. Individuals are selected based on factors including a minimal or no prior criminal history and case characteristics that indicate a need for structured supervision and/or treatment. While enrolled, accused persons are actively supervised by the Department of Corrections and must fully comply with all terms of the agreement in order to have their charges dismissed upon completion.

Cases will be submitted to a supervising Assistant State Attorney for final review after a referral has been submitted by the assigned Assistant State Attorney. If the case is approved for Pretrial Intervention Level 2, the Defense or the accused person (if unrepresented) will receive a Pretrial Intervention offer letter that will request a valid email address for the accused person. Once the email address has been received, a PTI contract will be generated which will require the signatures of the State, Defense, accused person, and the supervising officer. The report-by deadline for the accused person will be included in the language of the contract and the Defense and accused person will receive and sign the PTI contract through Dropbox. After the State, Defense, and the accused person have signed the contract, the contract will be sent to corrections by the State and the accused person will report to corrections to conduct the official intake process with their assigned supervising officer. The accused person will be officially enrolled in Pretrial Intervention Level 2 after their supervising officer has signed the contract.

The program lengths for Pretrial Intervention varies between 6-12 months. Any requests to extend a program length for Pretrial Intervention should be made prior to final review by the supervising Assistant State Attorney.

Requests for extensions during the participant’s Pretrial Intervention Program must be submitted to the participant’s assigned supervising officer.

Participants will be responsible for paying the cost of supervision ($20 per month for felonies and $50 per month for misdemeanors), cost of prosecution ($100 for felonies and $50 for misdemeanors), and, if applicable, pay the cost of investigation, cost of extradition, and restitution. Additionally, the participant will be responsible for paying any supplementary fees required by corrections. All monetary obligations will be paid through corrections.

Upon successful completion of the program the State Attorney’s Office will drop the charges against you.

The case will be removed from Pretrial Intervention: Level 2 and prosecution will continue.
