Pretrial Intervention Level 1
Program Description
Pretrial Intervention: Level 1 is a structured alternative to traditional prosecution administered by the State Attorney’s Office in partnership with Advent eLearning. Under this program, the State Attorney’s Office agrees to defer prosecution of a criminal case for 90 days while the individual completes specific diversion requirements. If all conditions are successfully met within that time, the State Attorney’s Office will drop the charges against the accused person.
The State Attorney’s Office will review an accused person’s criminal record, current charges, and case facts to determine eligibility for Pretrial Intervention: Level 1. If a case is determined to be appropriate for Pretrial Intervention: Level 1 a letter will be sent to the accused person and/or their attorney with a QR code for the accused person to register for Pretrial Intervention: Level 1 through Advent eLearning. The individual must complete the registration application and provide identification documentation. If the application is approved by the State Attorney’s Office, courses and requirements will be assigned to the accused person.
If you are a U.S. Citizen, you must provide a driver’s license, identification card, or U.S. passport. If you are NOT a U.S. Citizen, you must provide legal status documents, such as a passport and visa, asylum documentation or legal permanent resident documents.
Once an individual’s registration application is approved they will have 90 days to complete the program.
Program extension requests will be reviewed on a case-by-case basis. All requests to extend must be made prior to the participant’s due date. All program extension requests made after the due date will be denied.
Community Service Hours can be completed at any verified non-profit organization. Click Here for a list of suggested locations.
Pretrial Intervention: Level 1 participants are required to pay $100 program fee and a $25 donation to Central Florida Crimeline. Participants are also responsible for the cost of any required educational courses and, if applicable, the cost of investigation.
If applicable, the Cost of Investigation is paid directly to the arresting/assisting law enforcement agency. You will find further instructions for paying the Cost of Investigations on your Advent eLearning homepage. If you still have questions regarding paying your costs of investigation, contact us at diversionprograms@sao9.org.
Upon successful completion of the program the State Attorney’s Office will drop the charges against you.
The case will be removed from Pretrial Intervention: Level 1 and prosecution will continue.
